    El Paso police officer not charged after on camera shooting death of cuffed prisoner

    A TEXAS policeman who last year made headlines when he bought shoes for a homeless man during a freezing winter has been filmed shooting dead a handcuffed prisoner.

    El Paso police officer Jose Flores was captured on security footage shooting a suspect outside the city jail.
    Bodybuilder Daniel Saenz, 37, died after the bullet went though his shoulder and into his chest, piercing his heart.
    The video was released by the Texas Attorney General’s Office after a request from the El Paso Times.
    Saenz was under arrest for the alleged assault of an off-duty policeman and staff at the Del Sol Medical Center when the incident happened on March 8 last year.
    Officer Flores and a prison guard were transporting him to hospital for a self-inflicted wound when he began to struggle.

    The footage shows the two officers pinning a handcuffed Saenz to the ground as he kicks and struggles beneath them.
    They then get off Saenz and as he lays still struggling on the ground, Officer Flores draws his Glock semi-automatic handgun and shoots him.
    He then draws his Taser gun, jumps back on top Saenz who continues kicking briefly before becoming still as blood begins to pool on the concrete.




    Officer Flores administered CPR to Saenz before paramedics arrived. Saenz died in hospital from his wounds.
    In January last year Officer Flores made headlines for a different reason after he was pictured buying a pair of boots and some socks for a homeless man during a winter storm.

    A grand jury declined to indict Officer Flores over the shooting of Saenz, the El Paso Times reports.
    “After an investigation spanning months, and thoroughly investigating the shooting and the backgrounds of Officer Flores and Daniel Saenz, the grand jury took no action,” El Paso District Attorney Jaime Esparza said.
    Officer Flores took leave from the force following the incident. The El Paso police force is conducting an administrative investigation of Officer Flores’ actions. It is unknown if Officer Flores has returned to duty.

    Two cops. One suspect, already in cuffs. Would have thought a double Taser hit would have done the job. Wonder under what justification he got off?

    The perp was allegedly seen in the holding cell slipping his legs through the cuffs to bring his hands to the front, and the Cop claimed that earlier in the hospital he had been tazed 5 times to no great effect. On PCP maybe?
    Still, two guys with tazers and batons against a prone cuffed guy, what's wrong with a good ol' nightstick to the back of the noggin?

    Another one of 10 horrendous things to happen this month in the "Free and Democratic USA" while here under "Martial Law" they're ordering people to smile

    I think this is the whole point. Look how screwed up the US is - cops get away scott free with this - and students massacre students.

    Not America bashing - but hopefully you get the drift.

    As an aside I am surprised something like that happened in old El Paso, seemed such a sleepy place where the yanks transited to Mexico for their teeth done cheap, and the once mighty rio grande

    There are some really big guys out there - some of them on drugs like PCP which give them superhuman strength. And, since repeated previous tazering didn't appear to do the job, I'm betting on drugs being a factor. But, the key element is were the cops lives at risk?

    The fact that he was already cuffed tears it for me. Two cops...cuffed con...should have been another way.

    Also if he had already demonstrated his aggression and possible drug use he should have been in full irons, not just cuffs..

    Technically PCP does not increase strength. The users may 'feel' superhuman and the anaesthetic effect causes them to feel little/no pain when they are damaging themselves trying to perform feats of strength/violence, etc.

    But yes, because the user feels no sense of self restraint, they are extremely hard to subdue.

    It's a very fair point.

    But you shoot them in the leg.

    He acted out of spite - his judgement was emotional and very incorrect.
    He may of bought some shoes for a homeless dude in a moment of clarity but he's a bitter broken machine and if he doesn't go to jail - minimum he should be sacked and never allowed to go near a gun again (that's being Buddhist about it)

    ^Agree. Unless there is some really significant stuff that went on that we don't know about - but I can't imagine what that would be or, if it existed, why it hasn't surfaced.

    I have a lot of respect for cops - they do a hard, dangerous, poorly paid and generally thankless job. But, when a cop freaks out and panics, and shoots a handcuffed prisoner - he should be held accountable.

    It's our system, we have jury's, right or wrong, want to change it and put in what.

    2 story's, Oz St Vincent hospital Melbourne Oz, Prison officer put 2 rounds in a cuffed prisoner. Charged with murder, court throw it out, because that was what he was trained to do. Who's guilty, the officer, the trainers or the government who passed the laws.

    Second, me foot patrol Birmingham UK, radio call strange man with a knife, all on CCTV. Guys sitting on one of those big concrete pot plants, turn the corner and there he is. Say stand up and put your hands out, guy reaches for his waist. If I was armed, reflex, draw and shoot, wasn't so ran forward and punch as hard as I could.
    Guy was reaching to turn down his walk-man, all on CCTV.

    How you react is how you are trained, cops are people and the jury heard the evidence and decided. Jim

The civilian escort’s arm then hits the trigger hand of Officer Flores, causing his weapon to discharge.”

    Can't see it, did he say something bad about his mother or something?? I can not justify the force used, who the f'ck was the grand jury? Let him roll around and wear himself out having his tantrum, he's cuffed FFS.. Law enforcement is wound so tightly these days it's scary for everyone not just those breaking the law but even if one who simply runs a foul in a strange set of circumstances, it seems shot first, run them over with a car, send a dog after them and let it maul someone, ask questions later.. Yes there are more cameras these days so publicizing these incidents more which is why you'd think they'd be more careful but if they are that makes one wonder just how many have gone undetected over time. Like they always say when they pull you over, "I'm giving you the ticket for all the times you got away with it without being caught"..

    Personally have never had an instance where a cop has done me any good in any instance no matter how righteous I was.
