    An Irish teacher faces deportation from Dubai - after losing a three-year legal battle against a conviction for flicking his middle-finger at a driver.

    The Waterford man wants to stay in Dubai and the Irish community have begun a campaign to have him pardoned.

    Speaking on RTE's Morning Ireland programme earlier today, Mr Hayes denied making the action.

    “The only thing that could be, and I’m not saying this man is 100pc telling lies, as we’re coming to the roundabout I used my right hand to say we have to get into the left lane and we have to turn in here.”

    As well as the 'public obscenity' charge, Mr Hayes was also fined for having alcohol in his system, which he admitted to.

    Mr Hayes explained that anybody found with alcohol in their system are automatically fined €1,000.

    "Anybody who’s in any trouble they do a blood test and if you’ve any alcohol in system they’ll charge you. it’s a criminal offence if you make a gesture to everybody, it is completely against the law and the culture and I know that."

    But he categorically denies the 'public obscenity' charge.

    An expat teacher convicted of giving the middle finger to a policeman is set to be jailed and deported after a three and a half year fight to clear his name.

    Conor Hayes has already lost about Dhs600,000 in lawyers’ fees and lost income and is expected to have to pay Dhs18,000 in visa fines for overstaying when he is deported next month.

    However, friends within the Irish community have begun a campaign to keep him in the country and are looking at last-minute ways to have him pardoned.

    “No matter what happens, I would still promote Dubai to my friends abroad. I and my wife love it here, that’s why we fought so hard against the conviction, but options are running out,” Hayes said yesterday.

    Hayes, a teacher who is also known for managing an Irish soccer team in Dubai and hosting the Dubai section of the famous Rose of Tralee Irish pagent, has lived in the UAE with his wife for 11 years. He was told a Dubai court earlier this month that he will be deported after serving a one-month sen[at]tence for public obscenity.

    He was also fined Dhs1,000 for consuming alcohol without a licence, according to prosecution records. The incident occurred one night in January 2011 as he, his wife, Bernie, and two friends were in a taxi in Mirdif. The taxi pulled over to drop off Hayes and his wife and the car behind them beeped its horn loudly and flashed its lights.

    The driver followed them and claimed Hayes showed him the middle finger. Hayes was convicted in Dubai Criminal Court and fought for years to have the case reheard.

    However, he lost his appeal late last month and the original sentence of one month in jail and deportation was upheld. He lost his job two years ago because his passport was held with the court and he could not renew his work visa. He estimates that he has lost about Dhs600,000 because of the case.

    His friend, the singer Declan ‘Paddyman’ O’Sullivan, has posted campaign details on his website and said that huge numbers of people have come forward to offer help to Hayes and his wife.

    An expat businessman has been acquitted for a second time of flicking his finger at an Emirati motorist – and says the experience won’t stop him returning to the UAE.

    The US executive, who runs a technology company involved in a major UAE government contract, told 7DAYS he was now looking forward to being reunited with his ill father.

    “He almost died from a kidney stone and bladder problem while I was waiting for the case to come to court. I was really worried about him,” he said.
    The exec was accused of raising his middle finger at an Emirati motorist outside Stars ‘N’ Bars on Abu Dhabi’s Yas Island.

    The court heard the defendant was parallel parking his car when the motorist objected to having to wait. Both sides agree that the Emirati repeatedly honked his horn and that he got out of his car to complain to the businessman and his Caribbean-based business partner. However, the American strongly denied making the gesture.

    The defendant spent a day in custody and was charged with making a lewd gesture, which could have led to six months in jail. He was acquitted at a lower court in Abu Dhabi and has now been cleared by Abu Dhabi Appeal Court after prosecutors challenged the verdict.

    He said: “People are telling me to go home and not come back, but I will be coming back to the UAE. I’m trying not to let this experience affect my view of this country.”

    Back in the day one of our security boys was driving like an idiot trying to overtake me in a no-overtaking zone and honking his horn, so I gave him the middle one.

    I was summoned by the boss when his report came in - so we could have a good laugh.

    He said I was "driving erotically, and then waving the hand finger".

    Fined for drinking alcohol without a License ! So does that mean they have to take a drinking test before they get it ?

    It's just a "catch all" law that they use to punish arseholes that can't hold their drink.
