    PRETORIA (Reuters) - South African prosecutors on Wednesday won their bid to appeal the culpable homicide verdict handed down to Olympic and Paralympic athlete Oscar Pistorius for killing his girlfriend Reeva Steenkamp and will now seek a murder conviction.

    During the seven-month trial, the state failed to convince Judge Thokozile Masipa, 67, of Pistorius' intent to kill when he fired, leading to his conviction for negligent killing - culpable homicide - and a five-year jail term in October.

    State prosecutor Gerrie Nel said in his application to appeal on Tuesday that the judgment was "shockingly inappropriate" and requested permission to seek a murder conviction, which would carry a minimum 15 year jail term.

    Nel argued that even if Pistorius did not know Steenkamp was behind the door when he fired, the athlete showed intent to kill whoever was in the small toilet cubicle.

    "There was dramatic evidence from the first witness to take the stand - Pistorius' neightbour Michelle Burger.
    She said she and her husband were woken up at around 3am by "bloodcurdling screams" coming from Pistorius' home.
    Burger said: "She (Steenkamp) screamed terribly and she yelled for help. It was something you can't explain to someone else, how anxious those screams were."

    Yeah yeah I know all that shit. What I'm saying is that his defence was that he was shooting to protect himself. They had witnesses saying that it was Pistorius screaming that they heard.

    I think it's bollocks but that's what the judge believed.

    The question is does whoever handles the appeal see video testimony or will they just be basing it on the court records and the evidence?

    Because to my mind he was acting through most of his testimony.

    ^ Sorry, No sarcasm meant towards you, that judge is a nutcase, this guys a gimp but he's not deaf.

    Having been a cop then a lawyer to see this level of incompetence in any court saddens me.

    You know how much damage a judge like that will do in her career? I appeared before hundreds of judges in the USA and only met one I thought was insane and incompetent. Even when I lost, I understood why.

    The appeal will focus on the errors in the enterpretation of the law and other serious errors made by the Judge(s) rather than the evidence itself. There was more than enough evidence to get a murder conviction, but the bench was not up to the job.

    Pretty amazing actually that an experienced judge should be so influenced by bullshit, drama and the glow of celebrity status.

    JOHANNESBURG - Oscar Pistorius, the South African double amputee sprinter who shot dead his girlfriend, is scheduled to be freed on parole on August 21 after serving ten months in jail, officials said Monday.

    "He has been recommended for correctional supervision on August 21," Zach Modise, commissioner of the correctional services, told AFP.

    "Normally, this will mean house arrest with one hour of free time each day. As he progresses, we will relax these conditions."

    The 28-year-old was found guilty last year of culpable homicide -- a charge akin to manslaughter -- and sentenced to five years in prison for shooting model and TV presenter Reeva Steenkamp on Valentine's Day in 2013.

    Steenkamp's family have previously expressed anger that he could be released in August due to good conduct.

    Pistorius claimed that he mistook Steenkamp for an intruder, firing four shots through a locked bathroom door.

    Due to his physical disability, he is being held in the hospital ward of a Pretoria prison, shielding him from the often brutal overcrowded cells that are known for gang violence.

    State prosecutors are appealing against his conviction for culpable homicide, saying he should have been found guilty of murder.

    Pistorius released from prison under house arrest

    South African Olympic and Paralympic athlete Oscar Pistorius has been released under house arrest nearly one year after he was jailed for killing his girlfriend, prison officials say.

    He is expected to spend the remainder of a five-year prison sentence at his uncle's home in Pretoria.

    He shot Reeva Steenkamp through a locked bathroom door in 2013 but said he thought she was an intruder.

    Ms Steenkamp's relatives say they think Pistorius is "getting off lightly".

    Oscar Pistorius, 28, was found guilty of culpable homicide, or manslaughter, of his 29-year-old girlfriend at a trial in October last year.

    A case lodged by the prosecution appealing against that decision is due to be heard by the Supreme Court of Appeal on 3 November. State prosecutors say Pistorius should have instead been convicted of murder.

    The athlete was released on Monday evening, a day earlier than expected, according to a spokesman from the Kgosi Mampuru II prison, where Pistorius was being held.

    "Oscar Pistorius was placed under correctional supervision tonight," Manelisi Wolela confirmed in a statement.

    "The handling of the actual placement is an operational matter of the local management, and how they handle it is their prerogative that is carried out in the best interest of all parties concerned, the victims, the offender and the Department of Correctional Services," he added.

    Oscar Pistorius was driven under cover of darkness to his uncle's house 20 minutes away, a premature departure designed presumably to avoid the media glare, says the BBC's Karen Allen in Pretoria.

    South Africa's Oscar Pistorius will find out if he will return to jail when the Supreme Court of Appeal announces on Thursday if it will scale up the track star's conviction for killing his girlfriend Reeva Steenkamp from manslaughter to murder.

    The Paralympic gold medallist was released on parole in October after serving a fifth of his five-year prison term for the "culpable homicide" of Steenkamp, whom he killed by firing four shots through a locked toilet door on Valentine's Day 2013.

    Prosecutors said Pistorius, 29, should be convicted of murder and sent back to jail because he knew the person behind the door could be killed when he fired. A murder conviction would result in a minimum sentence of 15 years in prison.

    "The judgment will be delivered at 09:45 (0745 GMT) on 3 December 2015 at the Supreme Court of Appeal," the court said in a statement on Tuesday.

    Pistorius, whose lower legs were amputated when he was a baby, denied during his six-month trial that he deliberately killed Steenkamp, saying he mistook her for an intruder at his home.

    High Court Judge Thokozile Masipa ruled last year that the state had failed to prove Pistorius had shown "intent" or "dolus eventualis", a legal concept that centres on a person being held responsible for the foreseeable consequences of their actions.

    The state argued at the appeal that Masipa misinterpreted some parts of the law, including "dolus eventualis".

    If the court of appeal overturns Masipa's verdict, she will be responsible for passing a new sentence on Pistorius, according to legal experts.

    He killed his girlfriend Reeva Steenkamp in February 2013 after shooting her four times through a locked door.

    He is currently under house arrest after spending a year of his five-year sentence in jail.

    Pistorius will now have to return to court for a new sentence to be decided.

    so why hasn't his house arrest been rescinded immediately after the decision was made ?
    Aint there a good chance he will flee now ?

    If the shooting really was an accident he should have wrote a note saying what happened and turned the gun on himself .

    Instead we will have another court appearance next year , with him stood crying for himself again..
