    Amanda Knox won't return to Italy for a re-trial

    Amanda Knox, the American student accused of murdering her British roommate in Italy in 2007, said that "common sense" told her not to return to Italy for a retrial due to begin on September 30.

    "It's not a possibility," Knox said in an interview on NBC television's "Today" show. It is the first time she has said she will not go back to Italy.

    "I was imprisoned as an innocent person and I just can't relive that," she told "Today" show host Matt Lauer.

    Knox, 26, spent four years in prison for the murder of Meredith Kercher, whose half-naked body was discovered with more than 40 wounds and a deep gash in the throat in the apartment the two shared while studying in Perugia in central Italy.

    Following an appeal, Knox and her ex-boyfriend, Raffaele Sollecito, were acquitted in 2011 and she returned to her Seattle, Washington-area home. The Italian Supreme Court ordered a retrial in March due to inconsistencies in the appeal court's decision to release Knox and Sollecito.

    "There are so many factors that are not allowing me to go back - financial ones, ones where I'm going to school, ones where I want the court to proceed without distraction," Knox said.
    "I was imprisoned as an innocent person. It's common sense not to go back," she added.

    Knox does not have to attend the retrial and can be represented by her lawyers.
    She said she expected to win acquittal again at the new trial and insisted that not traveling to Florence to face her accusers should not be seen as an admission of guilt.

    "I look at it as an admission of innocence, to be quite honest," she said in the interview.

    Knox maintained her innocence in a memoir released earlier this year and painted herself as a naive young woman railroaded by a foreign justice system.
    Italy's Supreme Court has said the appeals court judges overlooked evidence against the accused. The high court wants a re-examination of the theory that Kercher was killed during a group sex game.

    At the moment, only one person is in jail for Kercher's murder: Ivory-Coast born Rudy Guede, who is serving a 16-year sentence.

    The bint is guilty as hell, she went back after the murder to clean up the mess.

    The only reasons she got off was because of Solecito's father and pressure from the USA and the fact that the Italian cops were such slack-a*sed b*st8rds.

    Seen a few doc's on this case and if both her and her boyfriend are guilty i would be surprised.
    They seem too normal, i know some can act normal at times but these both just dont seem capable whereas the black dude (drifter) that fled straight out of Perugia - that is the sole murderer for me.
    Can you imagine if Amanda Knox had helped a girl get her throat slit in a sex crime and remain so composed today as she seems ? - i dont.
    She is not another Jody Arias.

    I reckon the black guy who did the runner was guilty, probably the one who knifed Kercher, but Knox and Solecito were there, and cleaned up after, created diversions by moving the body, broken window etc.

    They were party to the crime, IMO.

    Unless they were high on meth. and dont remember it all then they are good actors ENT.
    But the whole investigation was so fucked up and if you are correct then these 2 will not live a long guilt free life as they are still young, for me it is the black dude alone.
    Italian police...,a few strong coffees top get them of their chairs.

    I was studying forensics at the time of the murder, and new internationally agreed protocols re. exclusion zones, exclusion of police etc from crime scenes, sterile environments and so on, which are now commonplace in an investigation, were just being established in January 2007.

    Italian police were slow off the mark in getting their forensics gudelines sorted, at the time.

    The case would have turned out differently if current protocols were in place then.

    I am at presently watching the Amanda Knox trial 5 key questions documentary , the window was broke and a stone was found in the room , this show proved the stone was thrown from outside and it was very easy to climb up and into the room , FACT , I think Amanda is not guilty for sure and the smoking gun DNA was transfered for sure , the young lady is innocent ,

    The entire trial was.

    1. a charade.

    Prosecution even made accusation of witchcraft, the occult. No evidence for that.

    2. Sloppy / or corrupt handing of evidence, including the DNA.

    Guilty, then not guilty, now prosecution wants to retry.

    The Italian justice system seems to function like most of Italian society: emotional, histrionic, dysfunctional, and disorganized.

    There seems overwhelming suspicion they were somehow involved. Exactly how isn't clear - or at least can't be proved - and that's what they're attempting to have a second go at proving. The black guy is most likely the one who shanked her, but was it part of a larger fight, a violent group sex session? As you say Knox and her boyfriend were almost certainly involved in some way.
    My mind is not for rent to any God or Government, There's no hope for your discontent - the changes are permanent!

    A court hearing Amanda Knox's second appeals trial has accepted a request to run additional DNA tests on the presumed weapon in the murder of Meredith Kercher, but rejected most other defence requests for new testimony or evidence.

    Presiding Judge Alessandro Nencini on Monday (local time) said the court agreed to test one DNA trace not previously examined because it had been deemed too small. A court-ordered review in the first appeals trial, which acquitted both Knox and her former Italian boyfriend, discredited DNA evidence on the kitchen knife linked to Kercher.

    The court also agreed to the prosecution's request to again hear testimony from a jailed Mafioso, Luciano Aviello, who has accused his brother in the murder. Aviello, a mobster who has been convicted of several crimes including defamation, is to testify on Friday.

    Italy's highest court in March ordered a new trial for Knox and her former Italian boyfriend, Raffaele Sollecito, overturning their acquittals in Kercher's gruesome 2007 killing. The star defendant and her former boyfriend were both absent at its opening on Monday.

    During opening statements, lawyers for Knox and Sollecito requested an array of new expert opinions and evidence to reach a definitive verdict, but the court rejected most of them.

    IN the third Italian murder trial of US student Amanda Knox, a court-appointed expert testified that the alleged murder weapon shows a new DNA trace that belongs to Ms Knox and not the victim.

    That testimony bolsters the defence, which claims the kitchen knife was not the weapon used in the bloody 2007 slaying of Ms Knox's British roommate, Meredith Kercher (21).

    Another piece of DNA on the knife blade initially attributed to Ms Kercher was disputed on appeal.

    Expert Andrea Berti testified that the new DNA trace from the knife's handle showed "considerable affinity" with Ms Knox's DNA.

    The DNA evidence on the knife found in a drawer at Mr Sollecito's place has been among the most hotly contested evidence in the original trial, and now in two appeals

    SENTENCED

    Ms Knox and Mr Sollecito were convicted in 2009 of murdering Ms Kercher, and sentenced to 26 and 25 years in jail respectively.

    The conviction was overturned on appeal in 2011, freeing Ms Knox to return to the US where she remains.

    Italy's highest court, however, ordered a fresh appeals trial.
