    New Mexico Bill Would Criminalize Abortions After Rape As 'Tampering With Evidence'

    A Republican lawmaker in New Mexico introduced a bill on Wednesday that would legally require victims of rape to carry their pregnancies to term in order to use the fetus as evidence for a sexual assault trial.

    House Bill 206, introduced by state Rep. Cathrynn Brown (R), would charge a rape victim who ended her pregnancy with a third-degree felony for "tampering with evidence."

    “Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime," the bill says.

    Third-degree felonies in New Mexico carry a sentence of up to three years in prison.

    Pat Davis of ProgressNow New Mexico, a progressive nonprofit opposing the bill, called it "blatantly unconstitutional" on Thursday.

    “The bill turns victims of rape and incest into felons and forces them to become incubators of evidence for the state,” he said. “According to Republican philosophy, victims who are ‘legitimately raped’ will now have to carry the fetus to term in order to prove their case.“

    The bill is unlikely to pass, as Democrats have a majority in both chambers of New Mexico's state legislature.

    UPDATE: 12:25 p.m. -- Brown said in a statement Thursday that she introduced the bill with the goal of punishing the person who commits incest or rape and then procures or facilitates an abortion to destroy the evidence of the crime.

    “New Mexico needs to strengthen its laws to deter sex offenders,” said Brown. “By adding this law in New Mexico, we can help to protect women across our state.”

    So a woman or girl is brutally raped, and she happens to be very diabetic, or have other medical conditions that would kill her if she got pregnant.

    Under this evil draconian and vicious law, that woman would be forced to risk her life to satisfy a stupid and naked ploy to ban all abortions

    I Think Ms Brown needs to move to Iran so that she can enjoy a REAL THEOCRACY, where all abortions are illegal, women are 5th class citizens with the same rights as dogs and donkeys

    Yeah because abortions, being medical procedures, have no paper work or anything that could provide said evidence.

    It's time for the GOP to come out and say directly that they want to legalize rape and outlaw abortion

    All this god bullshit - well, if there is a God, surely he also created bears? Moose? Wild cats? Deer? Rabbits? Wolves? All the other things that most of these republicans love to blow away with a gun of a weekend.

    Aside from the fact that it is possible with some abortion types to take a paternity test from the aborted foetus, they have rape kits as well to help with this stuff.

    They really are coming across like proponents of rape which is weird.

    it doesn't, but I suppose a DNA test can prove who is the father

    ^ Indeed - how scary is that. If you rape someone, the lady you raped will be forced to carry your child for 9 months, give birth to it. Then, a 3 second swab will be taken to prove you are the perp, and then the lady you raped will have the heart breaking decision as to what to do with the product of your crime. You will then, with a clever lawyer, be able to argue that because she carried your child it was not rape after all, or as the republicans like to call it, it was not legitimate rape, and go scott free.

    The thing that strikes me the most is you can get this same sort of cuckoo nutbar stuff coming from fringe elements in most every society, even the 'developed' ones.

    But they're exactly that: fringe groups who nobody pays much attention to. This is coming from an elected representative.

    ^the problem is that in mexico the fringe is the mainstream, ive known a few mexican women at university and they all quite genuinely believed that allowing birth control would bring a society crashing its needs. So you can imagine what their views on abortion were like.

    incidentally they were more boonme like resistant to the reality of Europe allowing both abortions and birth control and clearly not crashing to its knees

    if you count the theft in florida in 2000, republicans have lost 5 of the past 6 presidential elections....and they barely won in 2004.
