    Trespass

    Don,t know if any of you are aware of Thai Trespass laws, the following happened to me
    Got involved with a Thai lady on a buisness project, invested 3 grand GBP, she was supposed to spend the money on construction etc, Later I found out that nothing had started so I asked her for an explanation, non forthcoming, I engaged an Attourney to retrieve the money to no avail, no answer! I told the brief to take her to court, he said difficult to prove?
    So I went to her house which was inside a garden and knocked her door, she came out and told me to go away the money was hers! (she was fiddling with her mobile), Two weeks later my legal guy informed me that the Police wanted to interview me as I had trespassed onto private property and faced a Custodial sentence( you what!!), Off I went, got fingerprinted etc, I faced a charge, Upshot was that to have the charge dropped she would withdraw her complaint if I waived the debt, or go to court and risk Thai law, I chose the former.
    Be warned about entering private property

    If you've gone into this business deal without any legal backup/contract/receipt of payment I think you may as well kiss the money goodbye.
    If you have receipts etc then I'd say you've got a better chance but got knows how long in court plus any possible repercussions Thai style.

    In a nutshell she has admitted the debt to a third party and now she may be libel.

    Three grand (UK) mate, I hardly feel it would be worth your while.
    Principle, yes have her guts for garters! UP 2 U.

    That,s why I chose to drop it!! My point was did anyone know about trespassing on private propery in Thailand commands such a punishment
    PS she took photos with her mobile whilst I stood at her front door, that was her evidence!! I did not like the odds for a small amount!

    Interesting point here - a bit pedantic - maybe a TD member who is a UK "Legal Eagle" can clarify ?

    In my misguided youth I ignored a "Trespassers will be prosecuted " sign and entered a private estate intending to fish a nice looking pool.
    Was caught by the gamekeeper and appeared in the juvenile court the next week
    The case was thrown out as, although I should not have been there, the owner could not prove that I had "Trespassed" because even though I had entered the estate with the intention of causing a loss to the owner by taking a trout or two I was caught before I got to the lake.
    As I recall the magistrate said that to be guilty of "Trespass" the owner had to prove that he has suffered actual damage to his property or loss by my actions.

    Was the magistrate being lenient as he knew that my Dad had given me a bloody good hiding when the police delivered the summons ???

    Any thoughts ??

    Were you charged did you have to give the police surety? It seems not, so the police didn't think much of it and I reckon the public prosecutor's office would not have proceeded with court action.

    OK I got bluffed !!, MY POINT WAS ARE YOU ALL AWARE OF THAI TRESPASS LAWS REGARDING PRIVATE PROPERTY, you have to be invited into the area before entering

    why did you give her 3K withhout any surety or documents drawn up?

    what gave you the idea it was a good investment?

    I think most people are aware that if a Thai fucks you over and you go after them in any way they will play every trick/law possible to fuck you back.

    ^ doesn't matter.
    Under the constitution Thais are protected against people wandering on their property.
    If it is after sunset could be serious.
    If they shot you they would have a defence.

    She has a LTD company, producing herbs, seemed good idea, she signed a Doc on behalf of her company regarding the investment, the property is in her sons name, she has no tangible assets, (Daytime )

    So she was renting the property and there ia a company receipt of payment.

    She,s dropped charges , she does not pay rent to her son , even the Comp in her sons name although she is a director, just didn,t think it was worth pursuing for 3 grand

    Thanks for that Travelmate!! I should have been more meticulous in my wording of the contracts, or better still see a Lawyer to fully legalise it, especially here in Thailand, trust no-one! lesson learn,t
