    Court seizes Kamnan Poh's B15m bail bond

    The Criminal Court on Tuesday imposed a fine of 15 million baht on a daughter of Somchai Khunplome, better known as Kamnan Poh, a former influential figure in Chon Buri, after her father failed to show up to hear the Supreme Court's verdict on a murder case in which he is a co-defendant.

    The Supreme Court's verdict was due to be read today.

    The prosecution filed a case with the Criminal Court on July 8, 2003, charging Somchai, or Kamnan Poh, 73, the former mayor of Tambon Saen Suk Municipality in Muang district of Chon Buri province, and Passakorn Homhuan, 44, a member of the Tambon Saen Suk Municipality Council with premeditated murder.

    Somchai and Passakorn were accused of hiring Thanawut Kerdkiatkul and others for 3 million baht to kill Prayoon Sithichote, alias Kamnan Yoon, the kamnan of tambon Samet in Chon Buri's Muang district.

    Prayoon was killed on March 9, 2003. Somchai and Passakorn surrendered to police on April 17 and 24 but denied any involvement.

    The Criminal Court on June 21, 2004 sentenced the two to 25 years each in jail.

    The defendants appealed.

    On Oct 12, 2005 the Appeals Court upheld the lower court's verdict.

    Jiraporn Khumplome, Kamnan Poh's daughter, submitted a bail request and placed cash and assets worth 15 million baht as collateral for her father's temporary release pending the Supreme Court's verdict.

    Ms Jiraporn today could not produce sufficient evidence as an excuse for Somchai not being able to show up to hear the verdict. She had only four doctors' letters certifying that her father was sick in 2006.

    Passakorn, the other defendant, also could not show up. However, his bail guarantor showed a letter from the Tambon Saen Suk Municipality to the court certifying that he was unable to attend today's court hearing.

    The court found that Somchai had no intention of showing up to hear the verdict and imposed a fine of 15 million baht on Ms Jiraporn, who was the bail guarantor.

    The court re-scheduled the reading of the Supreme Court's verdict in this case for Jan 24 next year.

    Somchai, an influential figure in Chon Buri for many years, was also sentenced in 2006 by the provincial court and Appeals Court to five years and four months in prison for corruption involving the sale of a site in a forest reserve in tambon Khao Maikaew in Chon Buri in 1992 for use as a garbage dump.

    In that case, Somchai also failed to show up to hear the Supreme Court's verdict, due to be read on April 7, 2006.

    He is believed to have fled the country and gone into hiding in Cambodia.

    A case that was leftover from Thaksin's days, Kamnan Poh being the father of one of Thaksin's ministers. 8 years and the thing is still not over. 8 years of being free, while clearly guilty of murder. And people wonder why justice takes so long here. Yet another powerful, rich figure, who has avoided justice. Here is some background from the time....

    'Kamnan Poh' was set free on the Bt10-million government-bond bail by the Criminal Court here after being questioned for hours by investigative officers at the Royal Thai Police's Crime Suppression Division, said the news report of iTV.

    He surrendered himself to the police this morning after being accused of masterminding the murder of another local leader, Mr. Prayoon Sitthichoti, known as Kamnan Yoon.

    The court said that Kamnan Poh's requested release on the bail was approved, as he handed himself over to the police and was unlikely to escape or to intimidate witnesses.

    However, the court barred him from leaving the kingdom and ordered that he report to the police on April 27, said the T.V. news report.

    'Kamnan Poh' has recently been thrust into the media spotlight over allegations that he is responsible for the murder of ‘Kamnan Yoon’, of the eastern province of Rayong.

    The murder case followed last year's assassination of Pol. Lt. Col. Chaiyan Vichaidit, a senior police officer, who was said to be Kamnan Poh's right-handed aide.

    Kamnan Yoon was allegedly behind the death of the senior police officer.

    The police have affirmed although 'Kamnan Poh' is father of the Tourism and Sports Minister and is the most influential local leader in the eastern Chonburi province, they will never bow to any social pressure and will, instead, treat all parties fairly.

    Meanwhile, Prime Minister Thaksin Shinawatra has given the green light to authorities concerned to take appropriate actions on the case based on verified evidences, saying that there will be no political interferrence on the case as many have feared.

    Somchai Kunplome, Thailand's best-known "influential figure'', was sentenced yesterday to 25 years in jail for putting out a contract on the life of rival Prayoon Sitichote, who was killed by an unidentified gunman in March last year. Also convicted was Somchai's accomplice Passakorn Homhuan, who was also handed a 25-year sentence.

    After the verdict, Somchai, alias Kamnan Poh, and Passakorn were each released on Bt10-million bail pending the filing for an appellate review within 30 days.

    Defence lawyer Prachoom Thongmee vowed to try to overturn the guilty verdicts for his two clients.

    Somchai, regarded as the Godfather of Chon Buri, is in the midst of a high-stakes legal battle that could spell the end of his political and business domination of the eastern seaboard.

    In addition to the Prayoon murder case, he is appealing his five-year, four-month graft sentence for land-procurement irregularities.

    If he loses both legal battles, he could spend the next 30-plus years in jail.

    Criminal Court judge Anan Senkhum said in yesterday's verdict that the defence failed to show credible evidence in rebutting prosecution witnesses.

    Two prosecution witnesses were each sentenced to eight years in jail on charges related to the Prayoon murder after they came forward to implicate Somchai and Passakorn.

    "The court has no reason to suspect the two were trying to frame the two defendants," Anan said in his verdict.

    In reading out the verdict, Anan summed up the evidence that led to his decision.

    Between October 2002 and March 2003, Somchai and Passakorn had conspired to hire Thanawut Koedkiartkul, one of the two star prosecution witnesses, to contract gunmen to kill Prayoon, the judge said.

    The co-defendants also contracted Thanaphol Boonsri-uthai, another star witnesses, to assist Thanawut.

    The contract on Prayoon's life was worth Bt3 million.

    Thanawut and Thanaphol four times arranged for assassins to shoot Prayoon dead but they failed.

    Prayoon was eventually killed by an unknown gunman who remains at large.

    With regard to the contract put out by the co-defendants, the motivation was reprisal after Somchai's aide Police Lt-Colonel Chaiyan Wichaidit was gunned down by Prayoon's supporters, the judge said.

    Backed by Somchai, Chaiyan allegedly abducted and killed Prayoon's younger brother Prayuth Sithichote and his business associate Chamnien Huyweng.

    Chaiyan had siphoned Bt12 million from a cigarette-smuggling operation that he ran with Prayuth and Chamnien.

    In retaliation, two of Prayoon's relatives, Lertchai Karakit and Yothin Sithichote, shot Chaiyan dead.

    "The Chaiyan murder prompted Somchai to seek revenge and pre-empt Prayoon, killing him first," the judge said.

    "Even though the contract lapsed because the victim was killed before it could be executed, the hiring of gunmen and plotting the murder had already been committed," he said.

    Somchai appeared grim faced after hearing his verdict and refused to talk to reporters. However, his lawyer Prachoom insisted that his client's spirit was not dampened.

    "We believe we are going to win this case. There are still higher courts," he said.

    Accompanying Somchai from the courtroom were his five children, Tourism and Sport Minister Sontaya, Chat Thai MPs Witthaya and Itthipol, daughter Jiraporn and youngest son Narongchai.

    Chat Thai MP Surasit Nitiwutworaluck said no one imagined that the court would hand down a guilty verdict.

    Legal battles put Kamnan Poh's influence to the test The seemingly invincible image of Somchai Kunplome, better known as Kamnan Poh, has apparently lost its lustre over the past few years, culminating yesterday in a guilty verdict for masterminding the 2003 murder of a rival.

    Somchai was sentenced to 25 years in jail. Last year, Somchai was also convicted of bribery relating to the purchase of a garbage landfill in Tambon Khaomaikaew at a highly inflated price.

    He was sentenced to five years and four months in jail for that transgression.

    Somchai appears set to fight both guilty verdicts.

    But whether his remaining influence and connections with powerful people will be able to shield him from legal punishment remains to be seen.

    One of his sons - Sontaya - is tourism and sports minister while another, Ittiphol, is a Chon Buri MP. Somchai's protege, Niran Wattanasartsathorn, recently won a landslide election for the post of Pattaya mayor.

    Somchai was born in Chon Buri's Muang district in September 1937 to a village headman, and was the second of eight siblings.

    He started working when he was still a teenager, but managed to make serious money at the age of 26.

    In 1963, Somchai befriended a foreigner who owned several businesses in Cambodia and who held a concession to operate 15 fishing trawlers.

    The businessman allowed Somchai to get 20-per-cent commission from the trawlers' revenues. His marriage to Satil Sancharoen - whose father ran a fish-buying operation in Chon Buri's Bang Lamung district - added to his business fortunes.

    He additionally ventured into the construction business and soon registered the family's first company - Bang Saen Maha Nakhon.

    He has also co-invested in many other companies in Chon Buri and Bangkok.

    There are more than 20 firms under the control of the Kunplome and Sancharoen families.

    In 1968, Somchai became the kamnan of Tambon San Suk in Chon Buri. Seven years later, he withdrew from fishing due to oil-price hikes and decided to open Chon Buri Maha Nakhon company, a liquor distributor.

    Somchai later transferred many of his businesses to the supervision of his friends and aides as he focused mainly on construction and hotels.

    When Tambon Sak Suk was upgraded into a municipality in 1989, Somchai became its first mayor, which laid the foundation for his role in local politics.

    After pledging allegiance to the Chat Thai Party in 1995, Somchai's companies won many construction projects, especially when Chat Thai leader Banharn Silpa-archa served as premier.

    It is estimated that companies owned by the Kunplome and Sancharoen families are now worth more than Bt1 billion.

    Their combined assets are worth about Bt4 billion. On his way to power and fortune, Somchai clashed with many other influential figures.

    It happened so often that he often faced legal action, but most of the time he escaped legal prosecution.

    His first major challenge emerged when police arrested him and 16 others related to the garbage landfill in Tambon Khaomaikaew.

    The case dragged on for about 10 years until the court finally handed down a guilty verdict against Somchai in March 2003.

    The Court of Appeals upheld the lower court's verdict. Somchai - who was released on bail - is fighting the conviction.

    His worst crisis came when he was identified as the suspected mastermind behind the murder of business rival Prayoon Sitichote, alias Kamnan Yoon, on March 9, 2003.

    Kamnan poh is the Godfather of Chonburi. Palonchon, the family political party, swept Chonburi in the last elections (winning every seat), one son is in the Cabinet, another the Mayor of Pattaya. The expat press in Pattaya also eats out of his hand. He had a falling out with Thaksin some years back- over this case as I understand it- but his party is now in the governing coalition. If rumor is to be believed, his movements are far from restricted too. I very much doubt there is anyone in Chonburi who would dare to arrest him. Post coup rumors of his demise in Chonburi proved to be quite premature.

    The daughter of influential businessman and fugitive local politician Somchai Khunpluem who has been on the run from two convictions sentencing him to more than 30 years' jail, was yesterday ordered to pay Bt15 million for the father's failure to attend the reading of his final verdict.

    The Criminal Court judges told Jiraphorn that the four doctors' certificates issued five years ago submitted by her, claiming her father suffered from numerous illnesses, were not new and not enough to justify her request to postpone yesterday's session to next year.

    The court ordered Jiraphorn to pay Bt15 million, or her assets worth Bt15 million that she had posted as Somchai's bail, would be seized.

    The judges, who were supposed to read out a Supreme Court decision on his conviction for ordering the murder of a fellow kamnan based in Chon Buri's Muang district on March 9, 2003, granted the request from a co-defendant - Phassakorn Hommual - to postpone the session. Phassakorn had submitted a document explaining the reasons why he was unable to attend yesterday's session.

    Phassakorn is a member of the Muang Saen Suk assembly, which issued the document affirming that Phassakorn was on a flood-relief assignment from November 25 until tomorrow and could not attend yesterday's session.

    He and Somchai, better known as Kamnan Poh, are both based in Saen Suk.

    The session was rescheduled to 9am on January 24 for both Somchai and Phassakorn to hear the final verdict on charges of being behind Prayoon Sitthichote's death.

    Both Somchai and Phassakorn were found guilty of being behind Prayoon's death and sentenced to 25 years each in June 2004 by the lower court and Appeals Court.

    Somchai has also been convicted of land-purchase fraud in connection with the construction of a garbage dump and sentenced to five years and four months in prison.

    you are probably correct here, but who cares about the PAD these days ? their only purpose is to fight Thaksin, a former dictator, and that's the only thing they are good for

    why can't the reds push for a credible political agenda without their minion puppet Thaksin ? I am very skeptical of their true motives.

    Wasn’t that falling out more about casino licenses then any wish to clean the TRT of the mafia style godfathers that still riddle Thaksin’s inner circle?
    My understanding is that Thaksin had somebody in mind for the proposed Pattaya Casino and it wasn’t Kamnan Poh. Kmanan Poh was actually a client of Banharn at this time. Worth noting that 2003 was about the time that Thaksin was busy making Banharn redundant to his coalition by merging the New Aspiration Party into the TRT and making Chavalit deputy PM.
    But if you want to think Thaksin was trying to clean up the TRT, go right ahead.

    He was exposed to justice? It is 8 years after the crime he was found guilty of and he has never spent any time in jail.

    That's justice?

    I'm sure many criminals would be happy with such 'justice'.

    You should know that Police Major General Surasit Sangkapong was assigned Kamnan Poh's case, he was also the man who dealt with Chalerm's son and his 'incident' at a nightclub....

    The cabinet's reshuffle of the Finance Ministry and the Government Lottery Office is being seen by some as an exercise in rewarding those who have acted in favour of ousted prime minister Thaksin Shinawatra and Pheu Thai's economic policies.

    Surasit Sangkapong, who was the GLO director under the Thaksin administration, and Weerapat Srichaiya, a lawyer for Thaksin's ex-wife Potjaman Na Pombejra, were among three new GLO board members appointed by the cabinet yesterday. Another newly appointed board member is Lt Gen Rujawin Kijwit.

    Pol Maj Gen Surasit was among the officials indicted for their involvement in the sale of unlawful two- and three-digit lottery tickets during the Thaksin government. He stepped down from his police duties during a court trial in 2009, left Thailand to do business and reportedly eventually settled down overseas, but returned after Pheu Thai formed the present government.

    He also played a central role in Thaksin's controversial "war on drugs" which allegedly resulted in more than 2,500 deaths.

    Meanwhile, the cabinet appointed Benja Louichareon, deputy permanent secretary, as Excise Department director-general in place of Pongpanu Svetarundra, who was appointed deputy permanent secretary.

    I think he was trying to put socio-political and Judicial 'systems' in place more applicable to the late 20th, early 21st century than the demi- Feudalist model Thailand still represented at that time. I think his particular ethos was effectiveness, rather than 'cleanliness' however. His version of impartial 'Justice' remained selective.

    I do not admire Thaksin, I believe I have made that quite obvious. Like yourself, I remain suspicious of his motives. I admire his prominent and self serving political opponents even less however. Change is incremental, and basically takkie was, and remains, on the right side of it compared to the faded yellow peanut gallery.

    ^He does not admire taksin; his posts are very clear about it. He just believes that taksin can be manipulated as a vehicle to get Thailand's left wing in to power and make everything nice and rosy.

    Its a nice idea, and rather similar to that the iranian left wingers had when they worked with the islamists to over throw the iranian government in 1979. Unfortunately the thai left have as much chance of manipulating taksin as the iranian lot kumani.

    Sometimes one really does wonder about the alleged superiority of the western educational institutions. Certainly, if one goes by the doltish apologists for the PT party they have failed miserably.
