    Illegal to Use Thai Spouse in Land Ownership

    A fine example of Thailand ignoring its own laws until it has enough flies in the web, then sudden enforcement.

    PHUKET CITY: The director general of the Land Department has reiterated that foreigners using Thai nominees to buy land anywhere in the country will have their land title deeds revoked if caught – even if the nominee in question is a lawfully wedded spouse.

    Land Department Director Anuwat Meteewiboonwut made the comments during a recent stop in Phuket as part of a nationwide inspection tour of 30 provinces.

    The tour is aimed at improving public services by land officials in three areas: dress, conduct when dealing with the public and working harder to eliminate a backlog of work.

    Many members of the public have complained that it takes up to a year to complete a transaction that should only take one day, he said.

    Mr Anuwat, a former governor of both Phang Nga and Samut Prakan provinces, said he was satisfied on the first two points, but rated the general level of success among land officials nationwide at speeding up their work rate at “only 30%”.

    The next round of inspection tours will come in July, after which time personnel changes will be considered if service does not improve, he said.

    “We have to keep pressure on them, otherwise the work will not get done,” he said.

    As for foreigners seeking to buy homes in Phuket, they can do so through the Condominium Act, which allows foreign ownership of up to 49% of any project, he said.


    Foreigners cannot use a Thai spouse as a nominee to buy property in Thailand, however.

    “If the Thai spouse has enough money to buy the house that is fine,

    but if the Thai has no money and uses money given to him or her by a foreigner to acquire property, that is against the law. If we check and find out later that a Thai person has been using money from a foreigner to buy land anywhere in Thailand, we will revoke title deeds,” he said.

    Mr Anuwat said the provisions of [Ministry of Interior] ministerial order 43 makes it difficult to issue land documents quickly, as it requires action from a number of different agencies. Desire for land on the island has also led to encroachment problems here, he said.

    As a key market for property companies, Phuket is a constant source of problems and complaints to the director general’s office, he admitted.

    “We will try to resolve these problems and develop our personnel continuously in order to provide high quality services. Fortunately the governor of Phuket used to work in the Land Department, so he understands the procedures and can help co-ordinate all the agencies involved,” he said.

    Mr Anuwat was speaking of Phuket Governor Wichai Phraisa-ngop, who served as Land Office director in Nakhon Pathom in 1997 and as deputy director of the Land Department nationwide in 2003.

    When things are tight the first people they are going to go after are the foreigners who own land using nominee companies.

    Stands to reason that they will just begin to enforce the existing laws to meet the shortfall in their income. Foreigners are always legitimate targets.

    Would be absolutely hilarious if they started taking land and property off of foreigner's spouses though.

    Do you really need any more warnings not to try and circumvent the laws of this tinpot, joke of a country? Jeez...

    Is there a statute of limitations on this? There would be 100s of thousands of these properties i imagine.

    So its clear that under current thai law a farangs spouse can hold land legally and it would appear that this guy is making a prize tit out of himself

    My understanding the foreign husband has to sign a waiver dropping all claims to the property. I could be wrong.

    This law has always been there but if they do start to enforce it, it could become a serious international issue and will damage Thailand poor reputation even more at a critical time as the country moves into recession.

    This is the problem when the PAD “HiSo” elite gets into power they fear any competition especially foreign ownership: little dark skined Mrs Buriram must not have a nicer house than the pale skinned Mrs Ching.

    However the anomaly that upset the status quo was Thaksin and somehow, though I hate to say it, his return would be a welcome to compare with the current shit that is running the country.

    Butterfly and his followers will now hopefully see the light and that Abhisit is not the economic golden boy or a fan of the farang.

    I recall it was Thaksin who started the enforcement of the old land ownership rules. This is the man who owns half of Chiang Mai province.

    I have done exactly this on many occassions and all you have to do is sign a disclaimer saying the money was my wifes and the only reason they questioned her is because our kids have my surname.

    What's all this commotion about and if someone is questioned they will just have to fill out one of these forms.

    As far as buying properties and through a shelf company with Thai nominees then that is a big no-no.

    This is crazy.

    I fail to understand how this will help thailand at all.

    As I have always said RENT in thailand it is much better and you have little exposure !!

    Everyforiener I know has a thai spouse that will get the property in thailand when the "go to budda".

    What is he problem they spend money and normally become integarated in moo ban life and when they leave pEmANENtLY they give the missus the placeand a good living for he rest of her life .

    Every one is happy the girl the kwai and the people in the moo ban.

    the universal decree from the guys I have talked to is i have taken care of the family in the will and I want the house to go to the thai missus and enough money so she has a good life

    Who on earth would want to invest in the property market - with all the imbalances? It's so incredibly risky.

    I have no doubt he did so if he had to compete with any foreign competitor but there was a lot of dirty play going on in those days with some of the Thai media blaming Thaksin for many things. One I recall was the 0% on a farang bank account that was introduced by Siam Commercial and then Bangkok Bank with the others following.

    Thaksin’s government was blamed but it was really the banks decision.

    In no way I am defending Thaksin but the point I was trying to put over was that Convicted Fugitive Republican Bad Man Shinawatra seems a lesser evil.

    if they investigated all thais who own land and an house provided by a farang in thailand, and confiscated same:

    there would not be a bargirl or her family with an house, farm, car, or herd of buffalo left in in isaan!



    illegal to own land paid for by farang?
    would cause huge problems initially, but if the law applies only from this point onwards, i think it we would not have to listen to as many "i lost everything i ever owned" sobstories.

    correct.

    can't remember the wording, but something like the land is not considered as marital property.

    Gonna be a lot of Thais from the land office driving round the farang areas looking for those nice big expensive mansions
    First question will be to the neighbours asking if a farang lives there at the mansion, if that answer is yes then they are onto the money trail
