    Nope, the drinker is always at fault IMO, as for blame shouldering, when have you ever witnessed that in a motor vehicle accident?

    Absolutely a drunk driver is a murderer-in-waiting.
    In any particular accident, there can be many causative factors. That one driver was drunk and an idiot for driving drunk does not absolve or take away from other causative factors.

    It was not me that brought up another scenario, it was you.
    So, as per your example scenario, the Thai dad drives badly but is absolved completely? Would the accident have occurred if Thai dad drove properly and well, not speeding, not on the wrong side of the road and daughter was buckled in?
    We don't know, hence my question regarding the other driver.

    IF it was a case that Thai dad was doing dumb stuff while driving, then despite Mr N being a total arse and fuckwit, Thai dad must bear some responsibility too because if Thai dad had driven responsibly the accident may never have happened.

    I think the Thai system has something going for it : the drunken asleep driver must pay compensation to the girl's family. However as justice needs to be seen to be done, in order to deter others from doing the same without fear of consequences, he must be punished. Not maliciously......just as a deterrent to others.

    And there's the problem with the Thai system.
    Paying compensation is seen to be the deterrent, but to the rich it's not a detrrent at all, and to the poor, you can't get blood out of a stone. It's prison time, not for causing death, but for not paying compo.

    At that age when reaction times are slower and then to exacerbate it by being drunk. Obviously not a little drunk if he has fallen asleep at the wheel. Not sure if it is his total lack of responsibility or his stupidity that offends me more. Whatever happens to him the real loser is the little 10 year old girl whose future he has stolen and the parents who have been deprived of their daughter. No amount of compensation or jail time will fix that.
    Oh well at least he didn't say the brakes failed.

    The outpouring of judgemental disdain heaped on the driver in the context of this ghastly, hypocritical country is really quite absurd when we all know of the antics of the rich Thai slaughtering at will, almost, who exculpate themselves from any guilt and responsibility by manipulating the law and buying their way out.
