I've only pulled my daughter out once and that was last 2 days of the summer term last year as weren't going to be learning fuk all anyway as one day was a trip to Alton Towers and final day just consists of fukwittery. Anyway those 2 days of her bunking off school saved me over £700 in airfares to Thailand so would have happily paid the 50 or 100 quid fine but never heard anything from the school. Bar those 2 days she did have 100% attendance for the whole school year though.
Having a UK. Birth certificate and being registered in the education system kind of implies the child’s main residence,
if he’s nine and is in education in spoken English the uproute maybe deemed not good for the child
unless they have good schooling up there in isaarn

I suspect those expats with familes on contracts working around the world may dispute that.

Good schools in the UK cost lots of money, I'm Australian, my sister has kids grown now. a good high school Saint something was $20,000 a year each.
Kid may have better prospects here [Thailand] than ending up working in a minimum wage job in the UK, I have 2 kids born in OZ and attended school there, we live in Thailand now.
Their future, for now is brighter here, you may earn more in the west, but try and buy a house to live in, pay bills etc, SEA is booming, the west is dying

You are implying that any decent lawyer cannot find a clause in any countries book of laws, to suit his point of view.
What the courts ruling might be is possibly due to which law has precedence on any particular day, by any particular judge, due to how well he enjoyed his/her "lunch". Evidence be damned.

His wife maybe got into UK on a Settlement Visa on the basis of being his wife, and after a while she could have applied for Indefinite Leave to Remain.
The wife could have then applied to be a British National but when you work as a cleaner money must be hard to come by.
The boy was born in UK and in UK they put the father's name on the birth certificate regardless if they are married. A lot of countries do not, which leaves the kid as a national only of the mother.
In this case the boy could have got a British passport on the strength of the birth certificate, regardless of where born.
Getting a Thai passport for a kid in UK with a British father would not have been as easy, despite being allowed. The UK birth certificate is not a Thai document and would have required a number of expensive steps to be taken as read.
The kid could then have got a Thai passport but I doubt these two would have stumped up the money for the expense of getting him a Thai passport.
So it more likely than not that the mother took her son, who had a British passport but dual nationality, to Thailand and stayed there. The boy does not need a visa as a Thai national but his mum probably just got him stamped in as a tourist on arrival.
I imagine taking him through the airport with an expired visa in his British passport red flagged him and his father.
As a Thai National living in Thailand with his Thai parent, all of the rights are on the side of the mum. The courts typically automatically assumes she has custody or parental power unless the court has ruled otherwise and they cannot read a Scottish court's order unless it has gone through the Ministry and been recognised. Having parental power means she can determine if he is allowed out of the country.
The only way this chap will get parental power is to divorce her in a Thai court and get a settlement that gives him it, or get a concensual agreement from her that he has parental power. Either way he needs to get this sorted.
As to being in prison, he would not have been there for long on a charge of trespass, Thailand does give bail. The greatest mistake he has made was to try to flee the Kingdom with the child, the judge will not like that and he may languish for some time.
Solution - settle with her and make proper arrangements for the boy as any responsible adult should. "Stealing" kids is about denying the interests of the other parent, nothing more.
So case solved.....

He would not have made it past a Thai immigration counter at any crossing without being stopped if the boy had an expired tourist visa in his British passport. The guy probably had no idea of how to deal with that situation or that in places money can change hands to ignore it. If his story was really plausible he could even have paid an overstay fee for his boy and slipped through, but they are not dense in Suvaranabumhi.
Agreed, once across the border with a Cambodian tourist stamp, he could have caught a flight back to UK without difficult questions.
I will drink a single malt and feel sorry for him. At least one of those things. You marry a slag and stuff happens.
Keep in mind that he was with Sean Felton of Abducted Angels. I (as well as possibly) the father would hope that Sean had a clue as to what they were doing and which side of the law they were running with.

The abducting accomplice told porkies to the father. He suggested an escape without knowing anything.
I suggest all intending to abduct a child just ask the airlines what is required to board a plane with a child when the mother is not present. No airline will accept a passenger who tries to fly illegally as they themselves are liable for any mistakes.
So glad the check-in official was awake to the possible dangers and protected a possible illegally obtained child for use by whoever overseas.
Not a good advertisement for the Sean fellows business. Or is it a tax free charity scam? Is the "charity" liable for all costs involved due to it's illegal incompetence?
Are you suggesting a route to illegally abducted underage children, successfully, from Thailand into Cambodia and then onto another country then? Do Cambodian check-in officials not give a damn regarding under children trafficking?
