    Police to probe death of land official in DSI custody

    In a rare case of investigation, the Royal Thai Police says the family of the victim died in the custody of the Department of Special Investigation (DSI) could seek the hand of the police to investigate if they fear of foul play.

    At a press conference yesterday a Royal Thai Police spokesman announced that the relatives of the deceased had every right to file charges and ask for an investigation if they suspect any foul play.

    They can do so by filing charges with the Thung Song Hong police station, he said.

    He goes on to affirm that autopsy procedures performed by the Forensic Medicine Institute was in accordance with international standards and furthermore assured the public that the commissioner had placed the highest priority in finding the actual cause of death and that the case must be handled fairly.

    Meanwhile DSI deputy chief Pol Col Songsak Raksaksakul said today that a DSI official on duty at the detention room where the suspect was first reported to hang himself has contacted the Thung Song Hong police station for questioning.

    Thung Song Hong police investigator said so far only one DSI official who is a guard had been questioned.

    Justice Minister Gen Phaiboon Koomchaya also said the relatives of the victim has the right to file complaint to the police if they wanted to.

    He also said he was awaiting full report of the autopsy to know what exactly caused death.

    Khunying Pornthip advises family to see pathologist immediately to know exact cause of death

    The former director of the Central Institute of Forensic Science (CIFS) Dr Khunying Pornthip Rojanasunand advised the family of the former land official in Phuket and Phang Nga to see the pathologist who performed autopsy on his body as soon as possible to inquire about the exact cause of death.
    She said the pathologist could give explanation on all questions relevant to his death.

    The former CIFS chief was commenting on the controversy surrounding the death of the land official Mr Thawatchai Anukul in the custody of the Department of Special Investigation (DSI) one day after he was arrested in Nonthaburi for malfeasance in office over the unauthorized issuance of land ownership to influential people and businessmen to occupy forest and marine park areas in both Phuket and Phang Nga.

    Autopsy by pathologist at the Institute of Forensic Medicine revealed that Thawatchai died of internal bleeding as the result of the rupturing liver caused by impact by hard object.

    In any other civilised country there would have been a full blown murder enquiry by an independent investigatory body not associated with the law enforcement agency responsible for custody of the victim.
    This is a farce.

    OFFICIALS CLAIMED at the weekend that evidence showed a powerful crime network was behind the illegal registration of expensive seaside plots in Phuket and Phang-nga

    On August 30, Tawatchai Anukul, a former land official in Phuket and Phang-nga, was found hanged inside the detention room at the Department of Special Investigation (DSI) headquarters.

    The preliminary autopsy result, indicated in a death certificate issued by the Police General Hospital, said Tawatchai died because of a ruptured liver and suffocation.

    Emerging details about Tawatchai's death and other information led to public speculation the man had been murdered.

    According to the DSI, Tawatchai had many cases filed against him based on his work registering land deeds for more than 1,000 plots of public land in Phuket alone. The DSI got an arrest warrant issued for him based on charges he had granted the land deeds for plots in Sirinat Marine National Park.

    Before he abandoned his post and tried to escape his accusers, he was the land official in Phang-nga's Thai Muang district.

    The DSI claimed that during that time, he allegedly committed one of his biggest crimes by issuing more than 500 illegal land deeds at Khao Na Yak Mountain, worth up to Bt10.5 billion.

    He was speaking after he and a team of Central Police Forensic Science Division (CPFSD) officials examined the DSI detention cell in which Thawatchai allegedly tried to hang himself.
    Also present at the DSI was Thawatchai's younger brother, Chainarong Anukul, 63, who later spoke to the media during which he expressed doubts on DSI claims that security cameras outside his brother's cell were not working.
    Mr Chainarong said Wednesday that on Monday he had been initially invited to the DSI offices to examine camera footage only to be told by Pol Maj Jatupol Bongkochmas, chief of the DSI's Bureau of Special Operation, that the security cameras outside the cell were out of order.
    He also said he was not allowed inside the detention cell.
    "How on earth could they let the computer server break down without a backup system?" he said. He was referring to the excuse he says the DSI gave him as to why the security cameras outside the cell were not working.

    Mongkut Wattana hospital’s paramedics who performed chest compressions and CPR on former Phuket land official Thawatchai Anukul were summoned by police to Thung Song Hong police station for further questioning.

    Pol Col Mana Pohchuey, superintendent of Thung Song Hong police declined to elaborate why the paramedics have to be questioned again. But he, however, said that he was informed that the Institute of Forensic Science is now ready to perform another autopsy on the victim and is awaiting a go-head signal from a special panel of the Justice Ministry.

    The first autopsy showed that Mr Thawatchai suffered ruptured lungs and abdominal bleeding, sparking off suspension that he might be killed. But the Department of Special Investigation earlier suggested that a mishandled CPR by the paramedics from Mongkut Wattana hospital might have caused the lungs to rupture causing internal bleeding.

    Thawatchai who was facing a probe for allegedly forging documents to facilitate the issuance of title deeds for land plots worth over 10 billion baht in Phuket province was initially thought to have hanged himself with his own socks at the detention room of the DSI on the night of August 30.

    But the director of the hospital has categorically denied that the CPR process could have caused the fatal injuries.

    Meanwhile, Pol Maj-Gen Thawatchai Mekprasertsook, commander of the Police Scientific and Crime Detection Division, said his officers were trying to determine whether it was possible that the socks was used by the victim in committing suicide and whether they could have caused his death.

    First it was a shirt, then his socks that killed him by hanging, which, apparently didn't happen.

    Next, it's found that he died of suffocation, along with a ruptured liver and bleeding stomach.

    Now it''s ruptured lungs and stomach, from inappropriate CPR.

    Finally, it's back to the hanging theory, socks or shirt.

    The DSI's changed it's story too many times to be relied on to come clean on the death.

    DSI admits it does not have CCTV footage

    THE DEPARTMENT of Special Investigation (DSI) has admitted that it has no CCTV footage of the events surrounding the suspicious death of Tawatchai Anukul in a DSI cell because it claimed the system’s server is faulty.

    Police are investigating the death of Tawatchai, 66, to determine whether he was murdered in custody or committed suicide, as initially claimed by the DSI. He succumbed to a ruptured liver and asphyxiation a day after DSI officials arrested him on August 29.

    Public doubts have been growing following the incident, particularly after the DSI failed to present recordings from its CCTV.

    "Our CCTV system, which is linked to 49 security cameras, has worked properly but its server is faulty. It can't efficiently record what happened," DSI chief Pol Colonel Paisit Wongmuang announced at a press conference yesterday.

    He said the DSI had discovered the server problem in April this year and had signed a contract to improve the whole CCTV system on May 30.
