Supreme Court Judge Reveals On His Facebook Page
The Council of State has ruled that it is illegal for a driver to talk on a mobile phone while stopped at a red light, a former Supreme Court judge revealed on his Facebook page on Sunday.
Chuchart Srisaeng, the former Supreme Court judge, said the Council of State's 4th standing committee made this ruling after being asked by the Royal Thai Police Office (RTPO) whether it is a violation of Section 43 of the Land Traffic Act for a driver to talk on a mobile phone while stopped at a red light.
Section 43 prohibits a driver from talking on a mobile phone while driving, except with the use of a device that means the driver does not have to hold the phone while behind the wheel.
On receiving the police question, the 4th standing committee of the Council of State invited representatives of agencies concerned to discuss the matter.
The committee concluded that although a vehicle is stopped at a red light, the driver is regarded as still being in control of it and must be ready to move off when the light turns green. Talking on a phone without using a talking aid device while at a red light therefore means the driver is regarded as violating the traffic law.
