You should seek out a lawyer with experience of such issues.
It is my understanding that you not being legally married to the child's mother will prevent you from assuming custody of the child without the mother's consent. I believe unmarried mothers have the law on their side as regards custody.
However her 'nationality' or even lack of it might create issues for her as she is not Thai you say.

I can only see a court being able to sort this out

The first thing one should do on the birth of a child is obtain a passport. A passport is proof of nationality.

Yes, I did say that I would just leave if the relationship went south .
But I just cannot leave my son behind to live in squalor with no parents and live an horrendous life , hes a lovely little boy , kind natured and he needs me with him.
Growing up in a village will destroy him, I just cannot abandon him .
His mum is from the mountains, but she isnt hill tribe, some people from her village have got Thai I.D. but she hasnt (I have never said that she did have it).
Im on a Visa exempt stamp , but Ive been here for five years on various Visas .
I have investments back home

Yes, he has a Thai Birth certificate with my name on it, he has also taken my surname . The Thai birth certificate has "Non Thai National" written across the top .
I dont know what the BC states as his mothers nationality.
Just had a look and theres a space on the BC left blank on the mothers details section, maybe its been left blank .

I did enquire about that, but the British Embassy require the Mothers I.D or birth certificate to obtain a British Passport .
The Chiang Mai consulate said that he wouldnt be able to get UK citizenship .
Ive looked on the UK Gov website and seen the documents required and I cannot obtain them .
But it also states that people who cannot obtain all the documents can appeal directly to the Home secretary for a personal ruling .
Im going to the BKK UK Embassy soon to get a new passport , Im taking my Boy with me too see what can be done

Without any documentation you may have to go down the DNA route. Probably your only chance of proving paternity.

Not even the mother's name? That's unusual. She must have witheld that information from the hospital or asked for it not to be included. Surely that would give you more legitimacy than the mother to look after your child.

Yes, he has a Thai Birth certificate with my name on it, he has also taken my surname . The Thai birth certificate has "Non Thai National" written across the top .
I dont know what the BC states as his mothers nationality.
Just had a look and theres a space on the BC left blank on the mothers details section, maybe its been left blank .
Not even the mother's name? That's unusual. She must have witheld that information from the hospital or asked for it not to be included. Surely that would give you more legitimacy than the mother to look after your child.
There is only one blank space, all the other details are filled in
