    Lease land and building permit

    Hi,

    I signed last year a leasing contract for my Thai gf for a land, now i want to build on it my house, do i need his authorization, does she has to sign some papers to get the building permit ? What i have to do exactly ? Thanks a lot for your help !

    To clearify. Do you lease a land owned by your gf or does she lease land owned by someone else? So are you or she the lessee? How long is the lease for?

    Hi, thanks for your reply, i lease a land owned by my gf, she bought it last year and i signed a 30 years contract.

    And she is not your wife? And the lease is registered at the Land Office? What deed does the land have, Chanot or something else? Go talk to your Land Office. They will tell you what you need re. build permit. You must see that your name is on the build permit and other papers for the build because the name on these will be the owner of the house. And you need to take out a Superficies for your house. BEFORE you build it! The lease you have does not cover a house on the land, it is only for theland. If you do not do what I just said, you will not own the house when it is built.

    when i sign the lease contract she was my gf now she is my wife, the lease is registered to the land office yes and we have a chanote title. So i can get the building permit to the land office ?

    You need house plans drawn up before you can get a building permit, in Pattaya building permits are issued at City Hall, the Land Office which is about 8 miles away deals with land and house tranfers etc.

    One thing you have to be carefull here, you state she bought the land last year. How did she buy it, did you give her the money? If you did you are committing an offence. The law in Thailand now is any Thai woman buying land with money provided by a farang is committing an offence and if found out the land authority will cancel the land agreement and you will be fined.

    Not so dirty dog that is money for a shag and not money for land. That is classed as their earnings. But in the case of a farang wanting land and he gives the money to his girl friend or even his wife o that he can have control over it is an offence. There was a warning just after the coup, it was a new law brought in by the previos government. I have a 15 Rai farm but found a way around the law. What I done was give the money to my mother inlaw as a payment for having her daughter for my wife. My mother inlaw then gave the money to her daughter to buy the farm, so in affect my wife received the money from her mother.

    Another thing forgot to mention, in our area last year two government officials photographed me on our farm and wanted to know if I lived in the farm house which I dont. Thay were checking on all farms owned by Thai ladies who had farang husbands

    In answer to the OP's question about building permits, in Phuket it is the local government office (OrBorTor) who issues the building permit, so maybe Krabi is the same.

    They require to see plans of your proposed building. If it is single storey, then (at least my local OrBorTor) will sign off the plans and that's it - no onsite inspections. If it's not single storey, then they will do onsite checks during construction. (I think they are assuming that no-one can fcuk up the building of a single storey building, whilst building 2 or more floors is a little more difficult).

    For my commercial buildings, the OrBorTor would only sign the application in my name if I had a WP. For your private house this should not be a problem.

    One issue is that the OrBorTor likes the plans to be drawn up by a qualified person, as opposed to the somtam lady, and that the credentials of that person are submitted with the application, (copy of degree etc etc).

    If indeed, your plans were drawn up by the somtam lady, (as were mine), then you'll need to find a qualified person to put his/her name on your plans, and pay them a few baht for this.

    If your somtam lady has totally bugger-all knowledge of building plans, then you may have to pay quite a bit to persuade the qualified person to put their name to this 'liability'.

    But many somtam ladys do building plans as a sideline because the qualified persons are too busy making a fortune from plans for Big C, The Hi-So Condo Residence etc etc

    As for planning. Or permission to build it may be the case in large towns but out in the country nobody bothers with planning or permission.People who buy land out her start to build the next day,no permission needed.I have built three.

    Another thing,don't build until you get married.SHould you ever get divorced you can only claim half of the total assets acquired after you got married,so if you build a house first it cannot be taken into account when dividing up after a divorce.

    As far as renting, my wife and I viewd an apartment block which had just been built, each apartment had a large room downstairs and three bedrooms upstairs. The rent was 5 thousand baht per month. Not bad that.
