    Tenant leaving property - Lease agreement

    My wife has a small house which is leased out, with what i understand to be a standard lease (one month's rent up front and two months rent as deposit). Rent is due to be paid on Monday, but the tenant informed my wife yesterday that they wanted to move out in 18 days time. I think that it is most unlikely that any rent will be paid on Monday, and as there are months left on the lease, I don't think that any refund of deposit will be due, however my wife (forever Thai), says that we have to refund the balance of the deposit. What is actually the correct procedure here in Thailand?

    Keep all their money. A year lease is a year lease, they haven't lived up to their end of the agreement by moving out early. Pretty much the same as is the west.

    I agree with Earl also.

    My current one year lease clearly states that if I move out prior to end of lease I forfeit 2 month deposit.

    The only exception in my opinion would be: If you relet the house immediately upon the departure of the current renter then the deposit should be refunded. Otherwise keep the money.

    As a landlord I have to say it depends on the circumstances. If there is a death or sickness in the family from their home country and they have to return, ok. Common sense prevails.

    If they want to leave because they hate Thailand, I keep their deposit.

    Do I get taken advantage regarding my philosophy? Not often.

    I should add, I only rent to 'falangs.' Even my wife says "No Thais".

    Lets say the owner has had better tenants wanting to rent it at a higher rate for the last 3 months, why should the owner give back the deposit, the owner has kept their side of the agreement, the renters are breaking the lease.

    The only exception would be if there is an "expat clause" written into the agreement, I used to insist on these when renting, if you get transfered you have a legal out and money has to be refunded, if they just decide to move out you keep the deposit.

    I've been on both sides of the fence.

    Morally and possibly leagally, you have a 12 month lease it means the landlord should not throw you out early because they can get a better rent and cannot put the rent up. As a renter it means you owe rent to the end of the lease wether you are there or not.

    Keeping the deposit is a reasonable compromise here, unless they have a good reason and on 18 days notice it should be a bloody good one. As a landlord I have kept the deposit and as a tenant I have on lost it.

    And why exactly would your wife, and you, be biased towards Thais in regard to renting them a lodging?
