What a mixed up mess, forget it or get the land transferred into you sons name first, before any money changes hands. OP you mention a mortgage on the land with the bank, but not the house. I take that to mean the place has been built without planning permission. Strange enough the law here is similar to most western countries, just because Thais outside of the cities take little notice of the law doesn't make it legal. Charnote land does not give a right to build, just a freehold title to the land,
Get a Thai land lawyer to check the land and house out first, before making any deals. Jim
^ I personally would do as Jim has suggested.. So many possible ways to get bent over here. With all of the horror stories regarding farangs an property disputes in mind.. I would certainly at least have a lawyer look things over. I know you trust your wife and respect that but assumption is the mother of all things foked. Be careful man. Good luck.
I like the OP trust my wife totally, been married a long time and have 2 kids, but Thais don't know their own laws. Just because that's the way it's been done for 200 years doesn't make it legal today.
Some of the things I have been told as facts defy any logic what so ever. During a lunar eclipse a large frog jumps up into the sky and swallows the moon, that's a fact. Not the sort of people I would take legal advice from. Jim

I agree, it is a very iffy situation and far from ideal, but the family are straight-shooters and this isn't really for me but mainly just the wife and kid. I am still on the fence... we are off to a "money expo" (I know, sounds dodgy too!) at Impact soon to see about loans and I'll ask if it would be possible to get the land transferred to son's name first and do the mortgage in his name with me as guarantor.

To be fair I live in a remote area, locals were brought up on legend, folklore and village custom. Things like roads, electricity and TV are recent arrivals. No newspapers still and the old beliefs are still the truth.
The frog story come from the first eclipse I witnessed here, all the village were in the street watching the frog eat the moon. I being the first farang seen in these parts, everyone thought it was some farang joke about the moon being in the shadow of the Earth, or I was mad. Jim
