    Construction Defects Period Question:

    Hi Folks,

    Just spent ages searching but can not find, can anyone help with:

    We're looking for the relevant section of the Civil & Commercial Code that covers construction warranties/latent defect period associated with having a new house built.
    I've got a feeling it might be Section 600, but can't find it on net anywhere.

    I'm not being funny or anything but for what purpose exactly? You can't possibly be hoping that you can quote it when things don't turn out quite as you expect, are you?

    Hi The best bet is to stipulate in your contract that a certain percentage will be withheld for 'x' months to be used to correct any building irregularities. And there will be: note the cracked facade of most buildings: the usual suspects - poor quality cement,not enough cement powder in the mix, failure to keep cement moist for 30 days, and either the footing area is too small thus causing house to subside or most usually too large. In the latter case, the edges curl upwards and house sinks. A visit to any construction site will prove.

    How many months is "x months" though? and what percentage?
