I have this extension of stay on the basis I am over 50, married to a Thai and have fathered 3 kids here in Thailand.

I obtained this particular extension last December, there was no need for me to show any income or money in the bank.

Now a good friend of mine has just had his 50th and would like to obtain the same extension of stay on grounds of 7.17. However he and his Thai partner are not married,

Does anyone here know if marriage is necessary to qualify?

gjbkk, I know this doesn't answer your question but there is another thread here that discusses 7.17(5)

You might find it interesting to see what has already been said

I got my extension at main Immigration office at Bangkok, I went in in the morning and was granted the extension on the condition that I provided photographs of the house the following morning and returned without the kids.

It did help taking in the three kids with us, at the time of application they were 11 and 3 years old and the boy was just 1 month old.

During the interview the 4 year old demolished the rotary stamp holder on the officer's desk and the new kid just cried. I am certain they gave the extension just to get rid of us.

I found them quite helpful at they did show some sympathy towards my wife and I trying to maintain some order with the kids.

All I can advise is take the kids next time and best of luck

So far as I know only Bangkok has ever given an extension under 7.17.5

Will your friend be applying in Bangkok?
The requirements are that you are living in the same house as a dependent and over 50 years old.
It is certainly worth a try.

I think that if I have to put up with a bunch of kids that I will just carry on as I have been.

Sorry "know" was the wrong word to use.
Sun Belt posted that he had been successful in Bangers

How much did he have to show in Korat?

^ I've asked but as yet he hasn't forwarded a reply. But he did say that Korat sent his documents, for 7.17(5) extension, to Bkk and they were returned about 8 days later with permission granted. Strange why they had to be sent off to Bkk and Korat never issued the stamp. Perhaps this is how to go. Ask your local office to send your documents to Bkk for the stamp. If you want to contact the person yourself Thetyim I can supply his details. Could it be that Bkk has the only stamp in Thailand for Rule 7.17(5). It wouldn't surprise me that the Immigration Offices are too embarrased to admit it ?

Just checked and the reason why it was sent to Bkk was because the woman supervisor in Korat refused to issue the extension. Must have been one big slap in the face when it came back stamped as she has now moved. Not sure if to do with this incident though. Sadly I wont miss her. So the way forward is that if your local office refuses to issue it, have them send the application to Bkk. 8 days later job done and no draining trip to Bkk.

I was the one who helped this client in Korat to get his extension based on 7,17 (5) *support of a child. Yes, it went to BKK, he had to show some money. Can't tell you how much, I don't have the client's consent but this story was posted somewhere else. So, it's public, but not his bank account!

Yes, the captain left after but I believe it has nothing to do with it. And she is back...

I met them 2 weeks ago and we had a speech about 7.17 (5). I already posted what I know about it and I am kind of tired to repeat it... If you want to try it, go to immigration, show them the law, print some post from forums, argue...maybe you will get it, maybe they will ask money because you must SUPPORT the child, maybe the officer will be nice with you and do it. TIT.

I will do another one in January, don't know the date. The foreigner has an income of 30K per month. Not enough for retirement or marriage extension. I was told in Korat (because we double check before) that we should have no problem....

I am going down to Bangkok next weekend to apply for that visa on Monday 21st January. Previously I had a Thai wife support visa which expired in September while I was working off shore. I have done all the documentation so in a few days time the proof of the pudding will be ...........

This is a reply from phuket immigration via phuket gazzette regarding using support for invite from thai daughter to stay in thailand on 1 year visa.i have not used this as yet as i still have 6 months left on visa.
    interesting to note the remarks
However, although you don’t need to show a minimum income, you must show that your income is enough to allow you to be responsibly provide care for her.

Can I stay here because I have a Thai family?
I currently have a multiple-entry non-immigrant “O” visa that I obtained on the basis of being married to a Thai. I am 55 years old, but did not apply for a retirement visa because I still have business interests in Australia and must return there every 90 days.

When I am due for an extension of my “O” visa, can I apply for a 12-month extension under page five of the National Police Office Order 606/2006 – 7.17?

If so, will I still have to do 90-day renewals with this type of visa?

Additionally, I have a nine-year-old daughter whom I have adopted in Thailand and I would like to know what are the requirements if my daughter invites me to stay in Thailand under this order?

    S. Young, Karon.
“As you are married to a Thai woman, you can apply for a non-immigrant “O” marriage visa with multiple entries – as you have done. With this type of visa, you can apply for a one-year permit to stay, which will be granted if your qualifications comply with those listed in article 7.17 of the order 606/2006, which specifies proof-of-income requirements.

You can also apply for a one-year permit to stay as you have adopted a Thai daughter. The requirements are defined by the same article of this order.

However, although you don’t need to show a minimum income, you must show that your income is enough to allow you to be responsibly provide care for her.

You must also present all related documents that prove you are truly looking after her. These would include her birth certificate, documents that prove you have custody of her, receipts of expenses that relate to her such as education fees, clothing and so on.

Once you are granted a one-year permit to stay, you will not need to leave the country to renew your visa every 90 days.

    The Gazette notes:

You cannot “extend” a visa, only a permit to stay. Visas, issued by the Foreign Ministry through its network of embassies and consulates abroad, allow you to enter the country.

However, such entry remains at the discretion of the Immigration Police, who issue a permit to stay at the border checkpoint when you arrive.

It is these “permits to stay” that appear as a stamp in your passport near the corresponding visa, that can be extended to one year – if you meet the qualifications.

Confusion between visas and permits to stay are a common cause of visa woes by many foreigners living in Phuket.”

Living with my Thai child visa extension.
    Thai police order 606/2549 para 7.15 (5)

I am 63, married for 8 years this coming April and our son will be 4 in August.

I went this morning and arrived about 10.30 when the wife threw me out of the car and told me to get started while she found a parking space. I collected all the paperwork together at home and brought it all down with me but one thing I found is that the glue pot used to stick your photo on the application has 2 modes, not enough or bugger it now I need a new form and photo.
Then I sat and waited as the other 29 applicants in front of me plus many agents? went through the process plus the office, while not closed at lunch time showed a distinct lack of progress for about 45 minutes.
My turn came and as my wife and son had gone for lunch I called them back when there were about 2 people in front of me and we went up together.
At first the lady asked for proof of salary or income so I explained that I was applying to live with my son. Oh, OK was the reply. She preferred the passport and tabien baan copies in black and white and not colour so my wife went off and did that and the rest went smoothly except my wife was given another form to sign saying that it was all OK with her and I had to fill in the one for our son as he is only 3 1/2 and she took his thumbprint as a signature which was a surprise for him. She also gave him a few sweeties which he thanked her for.
The whole process took about 20 minutes and we were out of the building in just under 3 hours. I was also due to make a 90 day report next week but I got a small letter stapled to the passport which says that by completing the extension I have also notified them of the 90 days so that report is not due until 21 April now.
I have a month’s extension and have to report back on 19th February to collect the visa stamp hopefully.

This is a copy of the documents that I brought with me using both Sunbelt and firstly Badbankers information from last year.

I have a copy in Excel that I would like to pin for anyone else to use if some kind person will tell me how to do it.

Living with Thai child paperwork reqd
Sunbelt paperwork Original Copy 1 Copy 2
Yes No Yes No Yes No
1 A photocopy and the original of the foreigner applicant’s passport
2 A photocopy and the original of your child’s Birth Certificate
3 A photocopy and the original of your Marriage certificate (with child’s mother) which certified by
UK Embassy in Thailand as well.
4 a photo of me 4*6 cm to attach to the application form
5 a photocopy and the original of your wife's ID card
6 a photocopy and original of the Tabien Baan with wife and child named on the register
7 a map of the house showing the directions
8 a photo of the family at the house and about 4 photos of my wife, child and me in front of the house number and some inside
Child's mother to go to the immigration office with child and me because the officer will interview both parents. The applicant
will get the consideration time of 1 month and get a long visa after that.

You always have to do 90 day reporting, no matter what extension of stay, unless you travel out of the country before any 90 period. I actually have never filed a 90 day report in 8 years because I travel a lot. Every extension is only good for one year.

This extension is NOT to support a child it is to live with a child.
There is no age limited specified in the rules.

That might be the way for me to go, I have income but its derived from selling investments so hard to show a steady stream. Have one query tho, we were married in New Zealand, will this marriage certificate comply or do I have to get in notorised by those thieves at the embassy?

Under Consideration Criterions (4) for rule 7.17, it says "shall not be older than 20". Or am I reading about the wrong extention of stay ?

    Ivor,

Clause 3, 4, 5 have an "or" between them so you only have to comply with one of those three clauses not all of them

According to another forum they are now doing 7.17 extentions in Korat instead of having to go to BKK. Are they now doing this at all Immigration offices ? According to the forum, bank books have to be shown. It will be granted if money has been regularly deposited and withdrawls. Process takes a month so I've read.

I went to Nong kai immigration today to see about the 7.17 extension.
Showed the guy the regulations 7.17 and he said "only if divorced" WTF where does it say you have to be divorced? In fact it specifically mentions to produce proof of relationship such as marriage evidences (sic)
So I said If I get divorced from my wife I can get this visa, he said, Yes.
I said to him very politely and slowly, Can- you- read- this- and- show- me - where - it- mentions- divorce ?
His response, I don't need to, I know the regulations.
How the fvck do you deal with these morons?
